By registering as a My Dan Murphy's member, using any My Dan Murphy's membership facilities such as a My Dan Murphy's membership card or by seeking to access or use any My Dan Murphy's member benefits, you agree to be bound by these terms and conditions.
If you register as a My Dan Murphy's member, you may be able to access member-only benefits. (See 'How to Become a My Dan Murphy's Member' below.)
Member benefits are those which we specify from time to time in connection with My Dan Murphy's ('Member Benefits'). Member Benefits may include promotions, entry into competitions which we may run from time to time, discounts, exclusive offers from us and other selected third-party businesses ('Program Affiliates') and access to the 'My Offers', 'My Worlds' and 'My Tools' facilities which we may enable as part of My Dan Murphy's from time to time.
We may specify exclusions and preconditions (including qualifying spend and duration) for particular Member Benefits, and we may also change these, from time to time. Withdrawals of cash, purchases of gift cards, delivery charges, purchases of smoking/tobacco products and purchases of smoking/tobacco accessories do not qualify for Member Benefits.
Member Benefits relate only to our Dan Murphy's business (stores or online) in Australia. Some Member Benefits may be offered at various times in conjunction with Program Affiliates.
In order to obtain Member Benefits for any particular dealing with us as a My Dan Murphy's member, you will need to ensure that your membership is noted at the time of that dealing, for example by presenting your My Dan Murphy's card prior to the conclusion of a transaction.
Member Benefits may only be used for the personal, domestic and household use of the registered My Dan Murphy's member. Member Benefits must not be used for any other purposes, including for commercial and not-for-profit association purposes.
We do not exchange Member Benefits for anything else, including for cash or credit cards.
We may reverse (debit) any Member Benefits which have been allocated (credited) to you. We may do this where you have returned goods or have been refunded for services under transactions which have earned those Member Benefits or where there are other grounds which we consider reasonably justify a reversal.
We may choose to release a newsletter in which member benefits are referenced. Any references to ‘Offers’ or ‘Member Offers’ contained in this newsletter are personal to the named My Dan Murphy's member and are not transferable. Valid at all Dan Murphy's outlets (in-store, online and by phone order) upon entry of the member membership number, unless otherwise specified. While stocks last. Product offers are valid from the dates stated with the specific offers, unless sold out earlier. We reserve the right to limit sales to retail quantities. Excludes trade buyers and liquidation sales. Wine bottles are 750mL unless otherwise stated. Prices subject to variation based on state legislation.
A member benefit we may offer from time to time is entering you into our member-only monthly competitions. This benefit will not require you to accept any obligation in addition to those referred to in these terms and conditions unless we separately ask you for your consent (an opt in). We will send a communication to our My Dan Murphy's members of an upcoming competition.
For all future competitions, the terms and conditions which will apply will be those set out in the appendix to these terms and conditions (click on 'My Dan Murphy's Competitions Base Terms and Conditions'),and any additional terms applicable to a specific competition set out in the "Competition Details" referred to in those My Dan Murphy's Competitions Base Terms and Conditions, unless (a) we change these as provided under 'Changes to Terms and Conditions and Termination' below or (b) we notify that the terms will be different for a particular competition.
You agree that there is a separate agreement between us for each competition, and that such separate agreement will be (a) on the terms and conditions set out in the My Dan Murphy's Competitions Base Terms and Conditions; (b) also on these other terms and conditions (including the provisions under 'Competitions', 'Our Liability', 'Privacy' and 'Complaints and Queries' below) and (c) contain the competition-specific details.
As to competition-specific matters, in our Competition Details referred to above we will set these out including details of the prize, the competition period, the process for prize winner selection, other limits we may decide as applicable and all other details for the competition which are required by law. You agree that we alone may specify and determine these details and you agree to be bound by them under the agreement for the competition.
The competition prizes will not include those which are contrary to law.
How to Become a My Dan Murphy's Member
To become a My Dan Murphy's member you need to register as a member with us. Information about how to do this is available at www.danmurphys.com.au/mydanmurphys or by calling our Contact Centre on 1300 723 388. If you do not register you may not be able to take advantage of any Member Benefits. Registration involves you providing contact details and, if you choose, other profile information.
There is no joining fee to become a My Dan Murphy's member. Participation in some Member Benefits may require payment of a fee in addition to the price for any goods you purchase, for example a fee for attendance at a My Dan Murphy's member-only event. If there is such a fee, it will be stated as part of our promotion of the relevant benefit.
To become a My Dan Murphy's member you must be an individual aged 18 years or over. We may require proof of age to verify this.
My Dan Murphy's membership is non-transferable. Member Benefits are personal to you, for example your My Dan Murphy's membership does not cover your family or friends.
It is your responsibility to keep your personal details updated. If your personal details change and you do not notify us of the change, we might not be able to offer you Member Benefits and may cancel your My Dan Murphy's membership.
Additional terms and conditions
In addition to any fee for participation in some Member Benefits as referred to in the previous section, additional terms and conditions may apply to some Member Benefits or to some means by which Member Benefits are made available. For example, additional terms and conditions may apply to:
- any facility for your access to Member Benefits such as software and mobile applications (apps which may provide an e-card and/or the ability to access other Member Benefits online);
- events which you are invited to attend;
- particular content we may provide (for example education programs);
- and fulfilment of any of your orders for our goods or services. For example you may be requested to accept additional terms and conditions so as to receive certain delivery services.
Card and other My Dan Murphy's membership facilities
When you become a My Dan Murphy's member, we may make certain My Dan Murphy's membership facilities available to you to facilitate your access to Member Benefits. These may include tangible items (such as plastic or paper membership cards) or intangible facilities (such as our membership cards in electronic form (e-cards)). Some of these may be for temporary use only (such as tear-out cards from our in-store brochures). It is your responsibility to keep all of these My Dan Murphy's membership facilities safe and secure. If they are compromised (for example if your tangible card is lost, stolen or damaged or becomes unusable), you can request a replacement if you have registered as a My Dan Murphy's member with us and make your request via the My Dan Murphy's dashboard on our website. There is a limit of 3 replacement cards during any 12 month period. You may call our Contact Centre on 1300 723 388 if you have any questions or concerns about replacement cards.
We do not guarantee that all electronic facilities we make available as part of Member Benefits are suitable for all technology platforms. You may not be able to access online Member Benefits if your technology (including operating systems and software settings) is not compatible with the facilities we provide.
The issuing of My Dan Murphy's membership facilities is at our discretion. All My Dan Murphy's membership facilities remain our property and you do not have any rights in them which are exclusive or which may continue beyond the term we specify from time to time or the cancellation of your My Dan Murphy's membership.
Any tampering with or defacing of any My Dan Murphy's membership facilities will render those items invalid.
Please treat your My Dan Murphy's password as your confidential information and take care to prevent unauthorized use of or access to it.
Rejection, Suspension and Cancellation
We reserve the right at any time without notice to:
- decline to provide any My Dan Murphy's membership facilities; and
withdraw or cancel any My Dan Murphy's membership or My Dan Murphy's membership facilities or Member Benefits.
Grounds for doing any of these things include:
any abuse or attempted abuse of anything associated with My Dan Murphy's;
an act or omission contrary to these terms and conditions;
any reasonable suspicion of unacceptable conduct in connection with your membership of My Dan Murphy's, including any reasonable suspicion of dishonesty or wrongful conduct;
your bankruptcy or death; or
- your non-use of My Dan Murphy's (for example not logging into www.danmurphys.com.au/mydanmurphys or not presenting your My Dan Murphy's card for any Dan Murphy's transaction) during a 24 month period.
On cancellation of your membership (including through your requested deregistration) we may continue to retain your membership information for record-keeping purposes and, in de-identified form, for our general data analysis purposes and we may allocate, to another customer, any membership identifier (including number) previously allocated to you. You agree that we need not notify you in advance, or give you any reasons, as regards any action we take concerning your My Dan Murphy's membership.
If you no longer wish to be a member of My Dan Murphy's you can deregister by telephoning our Contact Centre on 1300 723 388. By deregistering your My Dan Murphy's membership, you will no longer be able to enjoy any Member Benefits.
You acknowledge and agree that there may be:
- delay in issuing you with, or non-issue to you of, any Member Benefits;
- delay in replacing, or non-replacement of, any My Dan Murphy's membership facilities; or
- an act or omission by us in the course of providing My Dan Murphy's (including as referred to in these terms and conditions),
and that to the maximum extent permitted by law, we will not be liable to you in any way or for any cause in connection with such matters. You agree that any comments, suggestions or recommendations you may receive from us or from others as part of your Member Benefits may not be suitable, accurate or complete and you must not rely on them in a way which may give rise to any loss or damage. If you intend to rely on anything in connection with My Dan Murphy's, your reliance should be solely on your own judgement including as to the extent to which you should obtain or use any Member Benefits.
You acknowledge that unauthorised access to your My Dan Murphy's membership account and personal information may occur if you do not take care to prevent anyone other than you and us from accessing information about your membership, including your My Dan Murphy's password.
Member Benefits may include the facility for you to provide content for example through contribution to interest-driven forums and via the "My Tools" facility at www.danmurphys.com.au/mydanmurphys. We want you to be able to do this but in a way which contributes to a responsible, respectful and inclusive community for everyone. In relation to your membership of My Dan Murphy's, the following are strictly prohibited and may be immediately removed or blocked by us (and you agree to us doing whatever is reasonably appropriate to facilitate this and to assist us in this regard), namely content:
- that could be considered defamatory, indecent, offensive, profane, unlawful or threatening (including to members of the public or us);
- referring to race, ethnicity, nationality, gender, age, sexual preference, religion or disability;
- that involves the making of personal attacks, name-calling, trolling or abuse in any way;
- that involves any misrepresentation;
- that involves spam, promotional material or links to 3rd party content (including others' websites);
- that might render us liable at law or under any codes to which we adhere (voluntarily or otherwise);
- without limiting anything else, that we regard as unacceptable in relation to alcohol;
- that does not present a mature, balanced and responsible approach to the consumption of alcohol beverages;
- that encourages excessive consumption or abuse of alcohol;
- that encourages under-age consumption;
- that promotes offensive behaviour in relation to alcohol beverages, or the excessive consumption, misuse or abuse of alcohol beverages;
- that depicts consumption of alcohol beverages other than in a responsible and moderate way;
- that may lead to alcohol beverages being appealing to children or adolescents;
- that features children or adolescents in the context of alcohol beverages, other than in natural situations (for example family barbecues);
- that suggests that the consumption or presence of alcohol beverages may create or contribute to a significant change in mood or environment;
- that suggests the consumption or presence of alcohol beverages as a cause of or contributing to the achievement of personal, business, social, sporting, sexual or other success; or
- (in the context of a celebration), that implies or suggests an alcoholic beverage was a cause of or contributed to success or achievement.
It is against the law to sell or supply alcohol to, or to obtain alcohol on behalf of, a person under the age of 18 years.
Subject to our commitments under 'Privacy' below, in respect of any content you make available for the purpose of your participation as a My Dan Murphy's member, you agree that we alone will own all rights of and incidental to use, reproductions, publications, communications to the public and adaptations of such content in any form and that you will ensure that neither you nor anyone else will have any rights which might preclude our exercise of such rights. For example, if you make a statement about us or any of our products via any of our interest-driven forums, you agree that we own the rights needed to reproduce that statement and communicate it to others, including members of the public, with or without attributing the statement to you and with or without making any changes to it.
If you have any feedback or question about a product purchased from us or service you receive from us, you should direct your feedback or question to us directly via email@example.com or by contacting our Contact Centre on 1300 723 388.
If you are an employee of any member of the Woolworths group of companies, please remember your obligations under Woolworths Group Limited Employee Social Media Policy, and direct any staff issues to your store manager or local HR representative.
Without limiting any other provision of these terms and conditions, you agree that the Member Benefits which you wish to be made available to you include us contacting you via all channels (including online media, telephone, mail and in person) and via all forms of direct marketing (including email, push alerts, SMS, MMS and providing free samples). You also agree to us contacting you in these ways, including for direct marketing, when you have chosen to receive communications from our Dan Murphy's online business.
You consent to each such communication except to the extent that you have opted out of it by using the opt out/unsubscribe facility we provide. If you are unsure of how to do this, please telephone our Contact Centre on 1300 723 388.
You acknowledge, consent and agree to the following in respect of your personal information.
- when you:
- register with My Dan Murphy's;
- take part in My Dan Murphy's promotions, competitions, testimonials, surveys and focus groups;
- participate in Member Benefits;
- communicate with us online, including when you shop online with Dan Murphy's;
- deal with us in other ways involving a need for personal information to be provided such as when you call our Contact Centre or bring a claim against us; and
- by accessing data from other sources and then analysing that data together with the information we already hold about you in order to learn more about your likely preferences and interests.
Most of the personal information we collect and hold about you is from your direct dealings with us but you agree that we may sometimes collect your personal information other than from you directly. For example from other suppliers who, in common with us, have a relationship with you.
- your My Dan Murphy's membership number;
- your personal details for example your name, addresses, telephone numbers, age and gender;
- what, how and when you buy from us or have expressed an interest in buying from us, including from our Dan Murphy's online business;
- whether you have taken up some of our other offerings, such as membership of Woolworths Group companies' other loyalty programs, financial services products and mobile applications;
- any rewards and redemption details applicable to your My Dan Murphy's membership;
- your participation in Member Benefits; and
- your stated or likely preferences, for example whether you may be interested in particular products or promotions.
You consent to us collecting your personal information which is sensitive information where that is consistent with us acting as a responsible supplier of alcohol beverages (for example information regarding any intoxication, abuse or public liability-related issues).
c. Why we may collect, hold, use and disclose your personal information: We may collect, hold and use your personal information for the primary purpose of selling and promoting our goods and services to you and improving on the range of our offerings, including for example:
- to facilitate your participation in Member Benefits;
- to learn of your likely preferences so that we may promote our goods and services to you in a way which may be of most interest to you; and
- to assist in investigating your complaints and enquiries,
provided that when marketing to you, we only use and disclose your personal information for Woolworths Group's own purposes or otherwise with your consent. We may do this via all channels (including online media, telephone, mail and in person) and via all forms (including email, push alerts, SMS, MMS and providing free samples).
We may disclose your personal information to those involved in providing contracted services to us (such as information technology services and mailing functions);Program Affiliates; our suppliers and third parties who you ask us to engage with.
We may collect, hold, use and disclose your personal information for other purposes which are within reasonable expectations or where permitted by law.
You may opt out of our direct marketing to you. Our direct marketing materials will tell you how to do this.
We may de-identify your personal information. We may do this for use and disclosure of the anonymous data to determine preferences and shopping patterns.
d. Consequences of not providing personal information: If you do not enable us to collect, hold, use or disclose your personal information, we may not be able to provide you with the goods or services you request or we may not permit your participation in our promotions or in My Dan Murphy's.

Before we provide you with access to your personal information we may require some proof of identity. We may charge a reasonable fee for giving access to your personal information if your request requires substantial effort on our part.
Changes to Terms and Conditions and Termination
Without limiting 'Rejection, Suspension and Cancellation' above, we may change, suspend or terminate these terms and conditions, My Dan Murphy's, and any benefits under My Dan Murphy's at any time. We will give advance notice of any such circumstance on www.danmurphys.com.au/mydanmurphys or you can obtain such details by calling our Contact Centre on 1300 723 388, allowing you to cancel your My Dan Murphy's membership within the period of that advance notice. Where we change My Dan Murphy's terms and conditions, My Dan Murphy's or any benefits under My Dan Murphy's, an updated copy of them will be available on www.danmurphys.com.au/mydanmurphys or by telephoning our Contact Centre on 1300 723 388. Continuing to use any My Dan Murphy's membership facilities such as a My Dan Murphy's membership card or seeking to access or use any Member Benefits after the period of advance notice has expired will be deemed acceptance of the amended terms and conditions.

In these terms and conditions, references to: 'we', 'our', and 'us' are references to the company doing business from time to time under the Dan Murphy's name and references to "you" and 'your' are references to the person who has registered as a My Dan Murphy's member; used any My Dan Murphy's membership facilities such as a My Dan Murphy's membership card or who has sought to access or use any Member Benefits; and
'My Dan Murphy's' means the customer recognition program we designate as such from time to time.
